The County Attorney's office is dedicated to protecting
the rights of the citizens of Winkler County by prosecuting criminal and
juvenile cases with justice and equity; by protecting victims of
domestic violence; by helping victims to recover appropriate restitution
from the perpetrators of crimes; by protecting the persons and rights
of abused and neglected children; and by providing the Winkler County
Commissioners Court with access to the best possible legal counsel.

CLASSES OF MISDEMEANORS:
This Office is responsible for the prosecution of Class A
& Class B misdemeanor cases that are filed in Winkler County.
Misdemeanor is defined in the law as any crime where the maximum
possible jail time is one year or less. There are three categories of
misdemeanors: Class A, Class B and Class C.
CLASS A

fine of up to $4,000 and/or
confinement in jail of up to one year

assault causing bodily injury
driving while intoxicated second offense
theft of property valued at $500 to $1500
resisting arrest

CLASS B
|
fine of up to $2,000 and/or
confinement in jail of up to six months
|
driving while intoxicated first offense
possession of marijuana less than two ounces
telephone harassment

Both Class A and B misdemeanors are handled in the County Court |
CLASS C |
fine of $500 or less
no jail time
|
|
Class C misdemeanors are typically heard in the Two Justice of the Peace Courts in Winkler County and Municipal Court Judge |
