| This Office
is responsible for the prosecution of Class C
misdemeanor cases that are filed in Winkler County.
“Misdemeanor” is defined in the law as any crime where the
maximum possible jail time is one year or less. There are
three categories of misdemeanors: Class A; Class B;
and Class C. |

PLEASE NOTE The Judge cannot discuss the merits of a pending judicial proceeding prior to trial. This means the Judge cannot discuss your citation with you or give you legal advice. We would be glad to help you with any procedural questions. IF YOU WISH TO ENTER A PLEA OF NOT GUILTY and desire a trial, you must so indicate by mail or in person by your appearance date. Please return this letter with your plea checked and a copy of your citation no later than the appearance date shown on your citation. You will be notified by mail of the court date set for your hearing. You have the right to a trial by jury if you so request. NOTE: The cost of impaneling a jury can in some instances be charged to the defendant. IF YOU WISH TO ENTER A PLEA OF GUILTY OR NOLO CONTENDERE, (no contest) and wish to remit your fine by mail, please so indicate in the proper space provided on the reply form on the reverse side. 1. Sign the plea of GUILTY OR NOLO CONTENDERE (no contest) and check the plea of your choice. 2. Determine the amount of your fine (s) by using the chart provided. 3. Mail this letter, your citation, and a MONEY ORDER OR CASHIER'S CHECK for the proper amount to the appropriate Judge. 4. IF YOU FAIL TO RESPOND TO THE CHARGE BY THE APPEARANCE DATE on the citation, AN ADDITIONAL CHARGE MAY BE FILED AGAINST YOU FOR VIOLATE PROMISE TO APPEAR ($260.00)AND WARRANTS ISSUED FOR YOUR ARREST. A WARRANT FEE OF $50.00 WILL BE ASSESSED ON EACH CHARGE FOR EXECUTING OR PROCESSING A WARRANT. ADDITIONALLY A FAILURE TO APPEAR OR SATISFY A JUDGMENT ORDERING THE PAYMENT OF A FINE AND COST IN THE MANNER ORDERED BY THE COURT MAY RESULT IN THE DENIAL OF A RENEWAL OF YOUR DRIVERS LICENSE. 5. JUVENILES 16 & under must contact the court with a parent or guardian. A JUVENILE WHO FAILS TO APPEAR BY THE TIME AND DATE ON THE CITATION MAY HAVE THEIR LICENSE SUSPENDED. *INFORMATION ON REQUESTING A DRIVING SAFETY COURSE IS PROVIDED ON THE REVERSE SIDE TELEPHONE CALLS DO NOT CONSTITUTE AN APPEARANCE BEFORE COURT

No one connected with the Justice Court, nor the Officer issuing the citation, receives any portion of your fine(s). All fines are deposited in the Winkler County Treasury.
